As results of the 2024 presidential election began rolling in, reports surfaced of U.S. Rep. Jamie Raskin from Maryland declaring the Democratic Party wouldn’t certify vote totals should former President Donald Trump win the election.

(X user @RepRaskin) This video comes from a February 17, 2024 panel hosted by Congresswoman Elissa Slotkin at a bookstore in Washington D.C. It centers on Richard Hasen’s book entitled, A Real Right to Vote,” which advocates adding an amendment guaranteeing voting rights into the Constitution and which can also serve as the focus for such discussions in American elections. Hasen himself was present.
At the conclusion of the discussion, a participant posed questions regarding Hasen’s proposed amendment and how it would be enforced. Hasen replied he didn’t trust either the Supreme Court nor other legislative bodies to uphold such hypothetical amendment and therefore suggested legal provisions as means for its enforcement in his book.
Raskin stated legislators need to play both offense and defense when protecting voters’ right to vote, with her contention being “for much of American history, the Supreme Court has been an adversary rather than friend to citizens”.
Raskin made this comment during his video posted above on X. Here is what Raskin stated within:
However, courts will not save us. Therefore, people need to come together and work towards amending the Constitution through legislative initiatives; but even this may not suffice; things inserted into it quickly slip out from under you — the best example being Section 3 of the 14th Amendment which they seem intent on disappearing despite clearly outlining what its intent was in regards to immigration policy and freedoms of religion outlined within.
Once Congress kicks the issue to us on Jan. 6, 2025, our job will be to inform Trump supporters he’s disqualified – which may require bodyguards for everyone and civil war conditions if nine justices – who don’t look at many cases every year and don’t need much work done anyway due to staff support – don’t do their jobs and interpret the 14th Amendment properly.
Raskin was making reference to Section 3 of the 14th Amendment. Congress added this clause during American Civil War 1860s so Confederates who defected could not hold office thereafter. A Colorado legal case attempted to apply this provision against Donald Trump due to his participation in Jan 6 2021 attacks at U.S. Capital, yet Supreme Court later overruled this legal argument and allowed Trump to remain on ballots in Colorado despite earlier legal claims of unconstitutionality by using Section 3.
Raskin made these remarks weeks prior to that Supreme Court ruling and seemed to support legal actions challenging Trump’s eligibility to run for President under 14th Amendment laws, not discussing results of 2024 presidential election or certification of vote totals.
Raskin did not say, as reported, “Let people cast their vote for Donald Trump if that is their wish, but remember this, we won’t certify his election – should he win, we will ensure he never steps into the Oval Office”. That quote has been misattributed.
