mes I have a teenage driver who will start their driving test within six months, any suggestions on their education/test prep etc? Submitted by OldGuy2828 on Thu Sep 5, 2024 at 7:40 pm.
My 16 year-old driver will turn 16 soon and I am most worried about protecting my assets (Connecticut has the “family car doctrine”, making the owner responsible). Thus, my idea is to give them their own car with enough funds in it so they can purchase insurance themselves if desired. Any suggestions are greatly appreciated!

Make your teen driver drive the car frequently. Make them the sole driver anytime they are with you in the vehicle – never take over yourself while they are present! Additionally, begin practicing “narrative driving”.Our car insurance did not change at all when our children had learners permits but not full licenses yet, giving you time up until 17.5 years old before anything needs to be addressed concerning coverage issues.

Check with your insurance broker/agent regarding getting high limit and umbrella liability policies to cover both learning drivers as well as those who obtain full licenses, making sure it will cover both scenarios adequately. Remember also to take any advice given from professionals as to helping children learn properly.RM

Prayer… and umbrella insurance coverages should always be in your budget, because no matter who has their own policy you remain responsible if someone gets injured on your property. Adding them as insured would likely prove significantly cheaper (and could even be required by them anyway!).

No doubt this will not provide the solution you seek, however:https://damicopettinicchi.com/articles/… -doctrine/ Although sufficient for establishing control, being the title owner alone does not establish it under family car doctrine – owner can have multiple meanings… Burdis v. Allstate Insurance Co. 44 Conn. App 53 (1996); In Durso v. A.D. Cozzolino Inc 128 Conn 24 (1941), the car title owner was an LLC. A CEO allowed his daughter to use the car for personal enjoyment and convenience; due to her negligence causing a collision. As such, under Connecticut Supreme Court’s Family Car Doctrine even though not entitled as title owner to sue under it vicariously as well. The Court determined that the “controlling element” of family car doctrine is intended use of vehicle rather than title ownership; accordingly, to establish vicarious liability under this doctrine, consideration should focus on ability to manage use rather than title ownership as the benchmark for vicarious liability assessment. See, for instance, Auth v. Wesley HHD-CV-030822570 2007, Conn. Super. LEXIS 1551 on this issue (June 14, 2007). Just because a household member doesn’t hold title to a vehicle doesn’t preclude application of this doctrine if other forms of control exist over that car’s usage; such as providing it as transportation and having some degree of influence over how its used. In such circumstances the doctrine applies.

No doubt this won’t address your concern:https://damicopettinicchi.com/articles/… -car-doctrine/Whilst sufficient for establishing control, title ownership alone does not constitute sufficient grounds to establishing it under the Family Car Doctrine; rather it has flexible meaning when talking about ownership arrangements… Burdis v. Allstate Ins. Co. 44 Conn. App 53 (1996); Durso v. A.D. Cozzolino Inc 128 Conn 24 (1941), wherein title to an automobile belonged to an entity rather than its individual title owner was also considered relevant precedents for interpretation of any applicable language within context and according to circumstances.” A Connecticut Supreme Court held that even though his daughter did not legally own the car, under family car doctrine he may be held vicariously responsible. The Court ruled that the “controlling element” of family car doctrine is intended use of vehicle rather than title ownership; hence to determine vicarious liability under this doctrine, investigation focuses on ability to govern usage rather than title ownership. See, for instance, Auth v. Wesley HHD-CV-030822570 (June 14, 2007). Just because a household member does not hold title to a vehicle does not disqualify it from this doctrine if there exists other signs that demonstrate control. If this household member provides it for driver use and exercises some measure of influence over how its usage, this doctrine applies.

Thank you so much, as i was fearful that something like that may happen!

Positively consider this possibility: Your teenage driver could become an even greater driver than yourself. Our daughter saved our lives because her response time was faster when an inconsiderate nearby driver did something stupid – something which makes me thankful she wasn’t driving instead of me! I am thankful she saved so many lives when they needed saving.
